This Privacy Policy explains how we collect, use and disclose personal data when you visit our website, contact us, subscribe to our communications, purchase editions or publications, attend exhibitions or events, or otherwise interact with NOA contemporary.
This Privacy Policy applies in accordance with Swiss data protection law and, where applicable, other applicable data protection legislation, including the EU General Data Protection Regulation (“GDPR”).

Depending on how you interact with us, we may process personal data including:

We process personal data only for purposes connected with our activities and to the extent reasonably necessary for those purposes.
3. Website Hosting
Our website is hosted and operated using Squarespace.
When you visit the website, technical information may be processed in order to provide, secure and operate the website. This can include information concerning your browser, network and device, your IP address, pages visited, referring websites, interactions with the website and timestamps.
Squarespace may process information on our behalf in connection with website hosting, functionality, security, analytics, ecommerce and related services.

4. Website Analytics
We use Squarespace Analytics to understand how visitors use our website and to improve its content, structure and performance.
Information processed for this purpose may include:
browser, network and device information;
IP address;
referring pages;
pages visited;
clicks and internal links;
scrolling;
searches;
timestamps and other information about website activity.
We do not currently use Google Analytics, Meta Pixel or other separate third-party advertising analytics tools on this website.
5. Cookies
Our website uses cookies and similar technologies.
Certain cookies are necessary for the secure and proper functioning of the website.
Squarespace may also use analytics and performance cookies in connection with Squarespace Analytics. Where required under applicable law, non-essential cookies are used in accordance with the visitor’s cookie preferences.
Visitors can manage their preferences through the cookie settings available on the website.
We currently do not use separate advertising or behavioural tracking technologies such as Google Analytics or Meta Pixel.
6. Contact and Enquiries
If you contact NOA contemporary by email, contact form, telephone or another communication channel, we process the information you provide in order to respond to your enquiry and manage the related communication.
This may include enquiries concerning artworks, exhibitions, commissions, institutional projects, press and media, collaborations, editions and publications, or other professional and business matters.
We retain correspondence for as long as reasonably necessary for the respective communication, business relationship, documentation requirements or applicable legal obligations.
7. Newsletter and Email Communications
If you subscribe to our newsletter or other email communications, we process your email address and, where provided, your name and communication preferences.
We use Squarespace Email Campaigns to manage and distribute these communications.
Our communications may include information about exhibitions, projects, artists, live performances, publications, editions and selected activities of NOA contemporary.
Squarespace Email Campaigns may also process information relating to the delivery of and interaction with our communications, including subscription activity and engagement with emails.
You may unsubscribe at any time using the unsubscribe link included in our emails.
8. Online Shop — Editions & Books
When you purchase an edition, publication or other product through our website, we process the information necessary to complete and administer your order.
This may include:
name;
email address;
telephone number where provided or required;
billing address;
shipping address;
products ordered;
order value;
transaction information;
order history;
correspondence relating to your purchase.
We use this information to process and confirm orders, process payments, arrange delivery, manage enquiries or returns, maintain required accounting and transaction records, and prevent fraud or misuse.
Squarespace may process customer and order information on our behalf as part of the ecommerce functionality of the website.
9. Payments
Payments through our online shop are processed by Stripe.
Stripe receives and processes the information necessary to process payments, authenticate transactions, prevent fraud and provide its payment services.
Depending on the payment method selected, Stripe may process payment details, transaction information, technical identifiers and information required for fraud prevention.
NOA Contemporary AG does not receive or store full payment-card details; these are processed directly by Stripe.
Stripe processes personal data in accordance with its own Privacy Policy.
10. Shipping and Delivery
For physical purchases, we may provide information required for delivery to the relevant shipping provider.
Depending on the destination and shipment, we currently use:

Information shared for this purpose may include your name, delivery address, telephone number or email address where required for delivery, and shipment or tracking information.
Only information reasonably necessary to arrange and complete delivery is provided.
11. Photography and Video at Events
Photography and video recordings may be made during exhibitions, live performances and other events organised by or in collaboration with NOA contemporary.
Such recordings may include identifiable visitors and may be used for:
documentation of exhibitions, performances and events;
documentation of Simon Berger’s artistic practice;
the websites of NOA contemporary and Simon Berger;
social media, including Instagram, Facebook and LinkedIn;
press and media relations;
editorial communication;
communication relating to exhibitions, performances and projects;
archival documentation.
Visitors are informed at the venue when photography or filming is taking place.
If you do not wish to appear in photographs or video recordings, we ask you to remain outside immediate recording areas where reasonably possible. During live performances in particular, visitors who do not wish to appear in recordings are asked to remain in the rear section of the room and outside the main recording area.
For targeted recordings in which an individual is clearly the main subject — including individual portraits, close-ups or interviews — we seek separate permission.
For comparable targeted recordings of minors, permission is sought from a parent or legal guardian.
If you have expressly objected to identifiable publication, we will take this into account when selecting material for publication.
If you later identify yourself in a photograph or video published by NOA contemporary or Simon Berger and do not wish the material to remain in use, please contact:

We will review your request and, where appropriate and within our control, remove or replace the material or cease its further use.
12. Social Media
NOA contemporary maintains profiles on third-party social-media platforms, including Instagram, Facebook and LinkedIn.
When you visit or interact with these profiles, the respective platform provider may independently process personal data in accordance with its own privacy policy and terms.
Content published on social-media platforms may be accessible internationally, and the respective providers may process information in countries outside Switzerland.
Our website does not currently embed a live Instagram feed.
13. External Websites and Services
Our website may contain links to external websites or services.
NOA Contemporary AG is not responsible for the privacy practices or content of external websites. If you follow an external link, the privacy policy of the respective provider applies.
We currently do not embed YouTube, Vimeo or Google Maps on the website.

Where processing falls within the scope of the GDPR, personal data are processed on an applicable legal basis.
Depending on the circumstances, this may include:

NOA Contemporary AG is based in Switzerland, but some of the service providers we use operate internationally.
Personal data may therefore be processed in Switzerland, the European Economic Area, the United States and, depending on the provider and its subprocessors, other countries.
In particular, Squarespace and Stripe operate internationally and may process personal data outside Switzerland.
Where personal data are transferred to a country that does not provide an adequate level of data protection under applicable law, we rely, where required, on appropriate safeguards or another lawful transfer mechanism.

We retain personal data only for as long as reasonably necessary for the purposes for which they were collected or as required by applicable law.

20. Children and Minors
Our website and online shop are not specifically directed at children.
Where an identifiable minor is intentionally made the main subject of a photograph, video recording, interview or comparable recording at an event, we seek permission from a parent or legal guardian as appropriate.

We may update this Privacy Policy from time to time to reflect changes to our services, technologies, legal requirements or data-processing practices.
